The First Layer online shop (hereinafter, the Seller) publishes this Distance Sale Agreement, which is a public offer to individuals and legal entities (hereinafter, the Buyer).
1. General provisions
1.1. This agreement is concluded between the Seller and the Buyer when an order is placed on firstlayer.com.ua.
1.2. Placing an order constitutes the Buyer’s full and unconditional acceptance of the terms of this Agreement.
1.3. The Seller reserves the right to change the terms of the Agreement without prior agreement with the Buyer. The current version is always available on this page.
2. Subject of the agreement
2.1. The Seller undertakes to transfer the goods into the Buyer’s ownership, and the Buyer undertakes to accept and pay for them under the terms of this Agreement.
2.2. The description, specifications and price of each product are shown on its page on the website.
3. Placing an order
3.1. The Buyer places an order independently on the website or through a manager by phone.
3.2. The Buyer is responsible for the accuracy of the information provided for delivery.
3.3. The Seller confirms the order by phone or messenger. If the Buyer cannot be reached within 2 business days, the order may be cancelled.
4. Price and payment
4.1. Prices on the website are in hryvnias and include all taxes required by Ukrainian law.
4.2. Product prices may change; the price of an already confirmed order stays the same.
4.3. The Seller’s full payment details are provided to the Buyer at checkout — under the “Bank transfer” payment option — and in the confirmation email. Payment is made by one of the methods listed on the “Delivery and payment” page.
5. Delivery
5.1. Delivery is carried out by the carriers listed on the website, at their rates and within their timeframes.
5.2. The risk of accidental loss of or damage to the goods passes to the Buyer once the goods are handed to the carrier.
5.3. The Buyer must check that the goods are complete and undamaged upon receipt.
6. Rights and obligations of the parties
6.1. The Seller undertakes to deliver goods of proper quality within the timeframe agreed with the Buyer.
6.2. The Buyer may return the goods under the terms set out on the “Warranty and exchange” page, in accordance with the Law of Ukraine “On Consumer Rights Protection”.
7. Liability
7.1. The parties are liable in accordance with the applicable laws of Ukraine.
7.2. The Seller is not liable for damage caused by incorrect installation or use of the goods by the Buyer.
